Introduction

When Does This Notice Apply? This Notice only applies to personal data that Paligo handles as a Controller (meaning where Paligo controls how and why your personal data is processed). This includes when you:

Visit or interact with the Paligo.net Site, our branded social media pages, and other Sites which we operate;

  • Register for or participate in our webinars, events, programs, marketing, and promotional activities;
  • Interact with us in person, such as when you visit our offices; and
  • Inquire about or engage in commercial transactions with us.

To the extent we process personal data on your behalf as a data processor, we agree to:

  • only process personal data on your behalf to the extent and in such a manner as is necessary for the purposes of fulfilling our contractual obligations against the controller, in accordance with the instructions given by the controller, and any further instructions that may be given; and
  • implement appropriate administrative, technical, organizational and physical safeguards and other security measures to protect and safeguard the personal data which is processed on your behalf.

If we engage any subcontractor which will process your personal data, we will enter into necessary data processing agreements directly with the contractor which includes obligations that are not less strict than the obligations of this Policy.

Collection and Use of Information and Personal Data

When you visit or interact with the Paligo.net Site, our branded social media pages, and other Sites which we operate or meet with us we collect and process:

  • Information that you provide to us, such as your name and email address;
  • Information on how you are using our services; how you are interacting with our website or application, e.g. browsing and click behavior;
  • Information you provide to us directly, including when you register and communicate with us directly through our Site, visit our offices, or participate in our events, marketing, and outreach activities.
  • Information collected from your employer or coworkers, including information about representatives or other employees of our current, past, and prospective customers, suppliers, investors, and business partners. We may also receive your information from a friend as part of a referral for our Services.

  • Information from public sources, including information from public records and information you share in public forums, such as social media.

  • Fulfilling a request from your personnel or respond to their inquiries;
  • Analyzing and improving our customer service;
  • Contacting your personnel if we believe that they may be interested in our Services;

  • Invoicing for the use of our Services.

When you use our Services we collect and process:

  • Information that you provide to us, such as your name and email address used to provide a registered account;

When you contact us for Support:

  • When you reach out to us for Support, we collect the information you give us, like your name and the email address linked to your account necessary to identify you and assist with your request.

We process the data for the purposes of:

  • Enabling your personnel’s use of the Services;
  • Fulfilling a request from professional services from your organisation;

We collect certain information, including e.g. name, email addresses and IP address, when an account is registered.  Moreover, we collect certain information when our Services are used, e.g. information on how the Services are used and technical information including e.g. the visited URLs, IP-address, browser type and version, and operating system. Additionally, we collect such information that is necessary in order to invoice you for the use of the Services and for processing of payments, including name and address. We may also retain information regarding your transaction history.

When we initiate communication with you, we process name and contact detail, information collected via third-parties, e.g. we collect information shared on your public LinkedIn account that indicate if you are interested in our Services.

Furthermore, we may use the information in order to communicate with you and the End Users regarding our Services. We may also use the collected information for responsible marketing purposes regarding the Services you have signed up for, and for other purposes set out in this Privacy Policy.

You have the ability to opt-out of receiving any promotional communications by following the instructions in any promotional email, or by contacting us at info@paligo.net.

Moreover, we may process collected personal data if it is necessary in order to: (a) comply with applicable law and regulations and lawful regulatory requests or relevant orders from competent courts; (b) protect and defend our rights, our property or our interests; or (c) protect our Services.

Legal basis for our processing

We process your personal data for the main purposes of a) providing the Services requested by you or responding to your inquiries, on the website or in the Services; b) fulfilling our obligations under the agreement with you for providing the Services (where such an agreement has been concluded); c) complying with legal obligations; and d) for pursuing our legitimate interest of marketing and improving our Services.

Paligo is committed to complying with the EU General Data Protection Regulation (GDPR), and the lawful basis for Paligo’s processing of personal data is primarily that the processing is necessary for providing the Services in accordance with Paligo’s Terms of Use, Paligo’s Master Service Agreement, Statements of Work for Professional Services, or that the processing is carried out in Paligo’s legitimate interests. We may also process data upon your explicit consent, asking for it as appropriate.

Security and Data Retention

We are committed to protecting your information and personal data. We take appropriate technical and organizational security measures in order to protect your personal data against loss, theft, unauthorized access to or processing of your personal data as well as against accidental destruction, loss, alteration and disclosure of your personal data.

Your personal data will be generally retained as long as necessary to fulfill the purposes for which we collected the personal data, as described in the section “Collection and Use of Information and Personal Data”, unless otherwise required by law. Once you and/or your company have terminated the contractual relationship with us or otherwise ended your relationship with us, we may retain your personal data in our systems and records to ensure adequate fulfillment of surviving provisions in terminated contracts or for other legitimate business purposes, such as to evidence our business practices and contractual obligations, to provide you with information about our products and services, or to comply with applicable legal, tax, or accounting requirements.

When we have no ongoing legitimate business need nor lawful legal ground to process your personal data, we will delete, anonymize, or aggregate it or, if this is not possible (for example, because your personal data has been stored in backup archives), then we will securely store your personal data and isolate it from any further processing until deletion is possible.

When using our Services, we only retain the Personal Data collected from a User for as long as the User’s account is active, or otherwise for as long as it is still relevant for the purposes for which we have initially collected it, as described in the section “Collection and Use of Information and Personal Data”, unless otherwise required by law.

We may disclose certain information, including personal data, to group companies, business partners and third party service providers for the purposes outlined above.

Moreover, you have the right to request that personal data which has not been processed in accordance with the GDPR shall be restricted, blocked and/or erased. You also have the right to be provided with your personal data in a structured, machine readable and commonly used format and to request that we transfer the personal data to another data controller without hindrance.
